eBike FAQ: Safety, Insurance, and Liability

Do I have to wear a helmet when riding an eBike?

Riders are not required by law to wear a helmet. HADCO urges riders to always wear a properly fitting helmet while operating an eBike. The Perfectly Fitted Helmet document at the bottom of this page was created by ODOT. 

I don't have a helmet. Can HADCO help me get one at a reduced or no cost?

At this time, HADCO does not have a program to provide helmets at a reduced cost. We recommend checking with the Roseburg Fire Department, Police Department, or UCAN about programs they may have available.

Can I take the eBike out on biking trails?

The eBike may be taken on paved bike paths throughout the city. The eBike may not be taken by vehicle to another location or used on off-road bike trails.

Can I ride an eBike on the freeway?

No, bicycles, including eBikes, are not allowed by law to ride on the freeway. According to Oregon Vehicle Code, an eBike is considered a bicycle, rather than a motor vehicle, except where otherwise specifically provided by statute.

Can someone else ride on the eBike with me?

Oregon law and HADCO eBike program policy prohibits more than one person from riding an eBike at a time. 

Does HADCO provide insurance in case an eBike is lost, stolen, or damaged?

HADCO does not provide insurance for loss, theft, or damage. If a HADCO eBike is lost, stolen, or damaged while you have it checked out, you may be liable for the cost of the repair or replacement.

Am I covered by HADCO's insurance if I'm injured while riding an eBike?

HADCO does not provide insurance of any kind including but not limited to: property damage, liability, personal injury, injury to others, damages, penalties, fines, losses, and/or expenses of any kind whatsoever. HADCO recommends that eBike Lending Library Program participants purchase their own insurance policy to provide appropriate coverage when using a HADCO eBike.

Can I be cited for driving under the influence of intoxicants while riding an eBike?

Yes, the Oregon Vehicle Code prohibits the operation of an eBike while under the influence.

I lost something during my ride. Will HADCO replace it for me?

HADCO eBike users are responsible for all personal belongings during their ride. HADCO does not accept any responsibility for lost or stolen user items. HADCO encourages users to report missing personal property to Roseburg Police Department.

I got a ticket while using a HADCO eBike. Can I be reimbursed?

No, eBike riders are expected to follow all HADCO policies and Oregon rules of the road while using an eBike.
